5 Cancellation Policy Terms

Canceling your reservation at least ninety-six (96) hours before the scheduled tour time will not result in any cancellation fees.
If you need to cancel within the window of ninety-six (96) to seventy-two (72) hours in advance, a fifty percent (50%) penalty will apply.
Cancellations made within forty-eight (48) hours or on the same day as the scheduled tour will incur a one hundred percent (100%) penalty.
To request a refund, please ensure that all cancellation notices are submitted in writing to Unique Tours Jamaica within the specified timeframes mentioned above. We appreciate your cooperation, and for any inquiries or assistance, feel free to contact us.

6. Complete Waiver of Liability, Acknowledgment of Risks, and Indemnity Agreement (“Agreement”).

This document holds legal significance. By affixing my signature, I renounce any legal entitlement to file lawsuits for any claims arising from my or my minor dependents’ involvement in this tour.

In connection with my engagement and/or acquisition of tickets for any of the Tours provided, including but not limited to Horseback and Donkey Riding, Zip-lining, Jeep Safaris, Bus Tours, Nature Tours, ATV and Dune Buggy Tours, Go-Carts, Walking Tours, Gem Mining, Challenge Course, River Walk Rum Tasting Tour, Catamaran Tour, Power Snorkeling, Skin Sky Diving, River Tubing, Kayaking, Bamboo Rafting, Pool, Waterslide, Blue Hole Tour, and Mini Boats (collectively referred to as the “Tour”), and in appreciation for being permitted to take part in the Tour, I agree to abide by the stipulations outlined in this Agreement, understanding that the Company will rely on these provisions, subject to the terms described herein.

Acknowledgment of Potential Hazards

I wish to engage in the Tour and fully acknowledge and embrace all potential dangers linked to my involvement in Land-Based motorized and non-motorized activities, encompassing but not restricted to potential contact with water, exposure to diverse weather conditions, the risk of slipping or falling on uneven surfaces, adverse reactions to food or drink, physical exhaustion, and other hazards and injuries that may occur during walking, riding, operating vehicles, and using cable equipment (such as self-inflicted accidents, mishaps, or those inflicted by other guests, automobiles, cyclists, animals, pedestrians, etc.). I am aware that horses are powerful, unpredictable, and potentially uncontrollable flight animals that may exhibit behaviors like bucking, rearing, biting, kicking, or bolting uncontrollably. They may also collide with objects, roll over, trip, or flip over, all without warning, especially in response to stimuli like sound, wind, shadows, plastic, wood, motor vehicles, bicycles, baby carriages, or sudden movements. I understand that the terrain may have hills, curves, and other hazards requiring a skilled and attentive operator.

I completely grasp and accept all risks associated with my participation in any water-based activities, including but not limited to exposure to potentially extreme weather conditions, slipping or falling on board a vessel, getting on or off a vessel, motion sickness, exhaustion, and other boat-related hazards and injuries (such as self-inflicted accidents and mishaps, interactions with other guests on the Tour, boat engines, marine life, poor sea conditions, etc.). I acknowledge that I may be engaging in activities in areas remote from competent medical assistance and that the crew might not be able to provide medical assistance but will offer aid until competent medical help arrives. I am cognizant that the risks may result in permanent disability and death, leading to severe social and economic loss. I comprehend and agree that it is my responsibility to evaluate the presented risks, and I am the ultimate judge of my ability to participate in the Tour. I authorize the Company to seek, on my behalf, all reasonable medical and surgical care necessary due to any injury I sustain while participating in the Tour, should I be reasonably unable to authorize such care myself.

Release and Waiver Agreement

I have carefully reviewed the preceding paragraph and acknowledge the inherent risks. As the participant (“You”), I affirmatively declare that I willingly accept complete responsibility and absolute liability for any potential loss or personal injury, including the risk of death, arising from my engagement in the Tour. This includes incidents caused by my negligence, negligent misrepresentation, breach of contract, breach of statutory duty, accidents, or other actions by Unique Tours Jamaica Limited (“the Company”).
In consideration of my participation in the Tour, I hereby relinquish, waive, and discharge Unique Tours Jamaica Limited (“the Company”), along with Princess Cruises, Royal Caribbean, Carnival Cruises, Costa Atlantica, Disney Cruise Lines, Virgin Cruises, Holland America, Norwegian Cruise Lines, Aida Aura, their employees, agents, successors, and assigns (collectively referred to as “the Company”), from any and all liability. This encompasses claims arising from negligence on the part of the Company, leading to personal injury, accidents, illnesses (including death), and property loss during my involvement in the Tour.
I explicitly agree that this waiver and assumption of risks are intended to be as comprehensive and inclusive as permitted by Jamaican laws. If any part of this agreement is deemed invalid, I acknowledge that the remaining provisions shall continue to be legally binding. The laws of Jamaica shall govern this Agreement, and I willingly submit to the jurisdiction of the Jamaican courts in connection with this Agreement.

7. I confirm the accuracy of the following statements:

I ATTEST that I am in sound health and do not suffer from any significant physical or mental ailment, respiratory or cardiac issues, or other conditions that might heighten the risk of injury or incapacity during Tour activities. I ATTEST that I will adhere to all safety regulations. I ATTEST that I have examined all provided equipment and am content that it is devoid of damage or flaws, committing to cover the cost of repairing or replacing any equipment damaged while under my care. I ATTEST that I am not under the influence of any substance or medication that could impede my ability to safely engage in the desired activities.

8 Binding effect

This commitment extends to my immediate family, legal representatives, heirs, recipients, and assignees. It also serves to benefit the Company, along with its successors and assigns.
I COMMIT to defend and protect the company from any and all claims, legal actions, proceedings, costs, charges, and responsibilities, encompassing personal injury, loss (regardless of whether resulting in death), damage or loss of property or belongings in my possession, and legal expenses, arising from my engagement in the Tour. I also pledge to reimburse the Company for such expenses incurred due to my involvement in the Tour, whether attributed to my negligence, negligent misrepresentation, breach of contract, breach of statutory duty, accident, or other conduct on the part of Unique Tours Jamaica Limited (“the Company”).

9 Image Consent:
I AUTHORIZE the Company to perpetually capture photographs, videos, and recordings during my participation in the Tour. I grant permission for the lawful dissemination of these visuals worldwide through any known or unknown media, without any obligation for compensation.
Each segment of this Agreement is considered individually severable. The invalidity or unenforceability of any clause, paragraph, or provision shall not impact the validity, legality, or enforceability of the remaining sections of this Agreement.

10 In case the participant is a minor

I AGREE to permit my minor to take part in the Tour. I acknowledge and accept, on behalf of myself and my minor, all the assumed risks and hazards outlined above, as well as all the exemptions and indemnities mentioned above. I consent personally and on behalf of the aforementioned minor to every clause mentioned above, having read and comprehended them fully. As the legal parent or guardian of the specified minor, I authorize the Company to procure reasonable medical assistance on my behalf for any injuries sustained by my minor during the Tour if I am not reasonably available to grant such authorization.

I have thoroughly reviewed this comprehensive release and waiver of Liability, assumption of Risk, and Indemnity Agreement. I completely grasp its terms and acknowledge that I am relinquishing my right to legal action. I am providing my signature freely and voluntarily, with the intention of an absolute release of all Liability to the maximum extent permitted by law.

11 Crucial Details

Kindly be advised that all cancellation requests need to be submitted through email. We process refunds in the sequence they are received, with a minimum processing time of 1-5 business days for Zelle payments and 1-10 business days for credit card transactions. Upon receiving your email requesting a booking cancellation, we will assess the eligibility for a refund based on the specific time frame of the scheduled tour or event.

12 Transportation Policy

Once your pickup time and location details are provided, you are allotted a grace period of 15 minutes. If, for any reason, you miss your pickup time, we regret to inform you that we cannot be held responsible for any inconvenience caused, and a refund for the event will not be applicable. It becomes your responsibility to arrange your own transportation to reach the tour location. In case you need adjustments in terms of time or location, kindly reach out to us in advance. Ensure to communicate any changes via email or text message. These rules and policies are in place to ensure the smooth operation and protection of both parties, as the service provider.

Refund Policy

Flexible: Complete reimbursement within a specified timeframe For guest-initiated cancellations, the charges incurred are contingent upon when Unique Tours Jamaica is informed of the cancellation. The minimum cancellation fees are outlined as follows:
Shore Excursions:
96 hours or more: Full Reimbursement
Less than 96 hours: Non-Refundable
Group Reservations:
60 days before the tour date: Full Reimbursement
45 days before the tour date: 50% Cancellation Charge
30 days before the tour date: 75% Cancellation Charge
Less than 30 days before the tour date: Non-Refundable.

Group bookings with individuals not meeting requirements do not qualify for refunds. e) UTJ may propose an alternative tour or a care package in certain situations. In such cases, clients must sign an Exchange for Service Form (Appendix 1), and no additional refunds will be provided.

e) UTJ may offer clients an alternative tour or a care package in certain situations. In such cases, clients must sign an Exchange for Service Form (Appendix 1), and no further refunds will be extended to the client.
1.5 UNJ is not obligated to re-book missed Tours and may accommodate the Customer at its sole discretion.
1.6 UNT reserves the right to cancel a tour due to weather conditions, acts of nature, unsafe conditions, or any valid reason. UNT will not be liable for any loss beyond the tour price due to such cancellations. In case of cancellation, UNT will attempt to provide advance notice to the Customer on available alternatives. If rescheduling is not possible, a full tour refund will be issued.
1.7 Certain Tours require a minimum and maximum number of passengers. UNT may cancel or modify Tours to meet these requirements. In such instances, UNT will strive to provide advance notice and offer alternative Tours. If rescheduling is not feasible, a full refund will be granted.
1.8 UNT, at its sole discretion, may make exceptions to this cancellation policy in unforeseen circumstances such as illness, accidents, or injuries to guests or immediate family members. Refund requests under this clause must be in writing and accompanied by a doctor’s certificate.
1.9 Refund requests for Website and Call Center Customers will be addressed by UNT within 14 days of receiving the request from the Customer, ensuring prompt resolution.

This authorization pertains strictly to a singular transaction and does not extend to any unrelated debits or credits on your credit card.
I grant permission to Unique Tours Jamaica to charge the credit card provided for this booking in accordance with the terms elucidated above. This payment authorization applies exclusively to the goods/services detailed on my booking receipt and for the specified amount. I confirm my status as an authorized user of this credit card and pledge not to dispute the payment with my credit card company. Any disputes related to FRAUDULENT TRANSACTIONS, LOST or STOLEN CARD, UNAUTHORIZED TRANSACTION, or DUPLICATE PROCESSING will render the transaction ineligible for a refund, provided it aligns with the terms stated in this agreement.
A signature from the cardholder will be required at checkout to confirm the booking. Unique Tours Jamaica retains the right to request any additional information necessary to verify a credit card payment. Please be aware that you may need to furnish proof of payment by submitting a physical government-issued ID and the credit card used for the payment.
